'data(...)' is null or not an object

As of 1.10.0 I get the following when I click on the window behind a modal dialog:

'data(...)' is null or not an object jquery-ui-1.10.3.custom.min.js, line 7, character 13553.

only happening in IE 8, Firefox works fine.

Anyone else seen this problem?  The Demo on the jQUeryUI Demos works fine...
