jQuery 1.3rc1 : Error with :not()

Hi,
I have 3 html TABLEs in my DOM
$("table:not(:first)").length()
gave me 2 (correct) tables in 1.2.6
gives me 5(???) tables in 1.3rc1
also, doesn't work the version:
$('table').not(':first').length()
