you can take a look to the /experiments/scrollview, it does what you want

I tried it and the example works fine, but I wasn't able to create my own scrollview page.

From what I see in that example, the footer does not persist during scrolling. It still disappears during. What it does do is persist during page transitions. While that is helpful, it is not what the OP was asking for. I am looking for the same functionality as the OP.

Use iscroll. Also search on github for jqery.mobile.iscroll.js, a simple JQM plugin for using iscroll. The plugin is pretty basic and could use some work, but it will work for a simple case of a single iscroller on a page.

Use data-position="inline" on your header and footer, and prevent scrolling of the overall page with:

document.ontouchmove = function(event) {
  event.preventDefault();
}

I wouldn't expect to see true fixed header/footer support in JQM except when explicitly supported by the underlying browser platform (like iOS5/Mobile Safari). This has come up again and again, and no matter how popular the feature of fixed headers/footers might be, I don't think you will ever see it.
