Is it ok if you not to use ui-content for your listview ? :
The usual way:
<div data-role="page" id="index">
<div data-role="header">
</div>
<div role="main" class="ui-content">
<ul data-role="listview">
<!-- listview content -->
</ul>
</div>
<div data-role="footer">
<h4>Footer</h4>
</div>
</div>
What i'm using:
<div data-role="page" id="index">
<div data-role="header">
</div>
<ul data-role="listview">
<!-- listview content -->
</ul>

</div>
Is it ok to use it like that or am i breaking something ?

It is fine not to use content div. it is a div that adds padding, nothing more. Wrap content in any div you want or don't wrap them at all.
